involved persons, to notarize an affidavit to assist in his
court application.

Please find a template of an affidavit [that I will be
swearing].
You will need to insert your name and particulars in the
appropriate places, and swear to your truth.
There is no direction that I can see as to where to send
these once completed.

So I will encourage you to send them to Box 46 - 3398
Kingsway, Vancouver, BC V5R 5L2, until we get further
direction from Wally Dove.
I will ensure that those that come here will be forwarded to
him in due course.

I have also attached the SCC case in which the fact that
judges are appointed and paid by the federal government was
stated (highlighted portion of paragraph 71.

Please note that the highlighted portions of the affidavit
are those items that you will have to alter or deal with in
some way. Additionally, please feel free to modify the
affidavit in any manner you deem fit.

Subject: Affidavit in support of my application for a
judicially independent judge

Hi Folks,

I am requesting that as many of you as are willing, swear
the attached affidavit and return to me ASAP. I will use
these affidavits in support of my Application for a
Judicially Independent Judge in my case, which I will be
making on September 15th, 2003.

If you would, please circulate this request as widely as
possible. I will use every affidavit I receive.

Please note that any of you who live outside of Ontario and
wish to swear this affidavit, must use a Notary Public, not
a Commissioner, or the affidavit will not be accepted by the
court.

As many of you know, there is a publication ban on my Income
Tax matter that is currently before the courts. They are
obviously concerned about the evidence that I am presenting
to the court and the support I have been receiving as
evidenced by the number of people who attend at court when
they are permitted. I would like to take this opportunity to
thank you all for your support.

This matter is now in the Ontario Superior Court, 48+ months
after the charges were laid and trial is not scheduled to
begin until November, 2003.

Motions in this matter are scheduled to begin on September
15, 2003.

I have 12 Motions to bring before the court, one of which is
an Application for a Judicially Independent Judge. I have
brought it to the attention of the Preliminary Hearing judge
that I had a reasonable apprehension of bias on the part of
judges in this matter, but to no avail.

I have brought it to the attention of the Pre-trial judge in
the Ontario Superior Court of Justice, where it is more
obvious that a bias would be present when the Supreme Court
has stated that Superior Court judges are appointed and paid
by the federal government. For example the following quote
is taken from a Supreme Court decision in Canada (Human
Rights Commission) v. Canadian Liberty Net [1998] S.C.J. No.
31;
"The provincial superior courts have always occupied a
position of prime importance in the constitutional pattern
of this country. They are the descendants of the Royal
Courts of Justice as courts of general jurisdiction. They
cross the dividing line, as it were, in the
federal-provincial scheme of division of jurisdiction, being
organized by the provinces under s. 92(14) of the
Constitution Act and are presided over by judges appointed
and paid by the federal government (sections 96 and 100 of
the Constitution Act)."
Therefore, it is my opinion that it is impossible for a
federally appointed and paid judge to be unbiased when
adjudicating a federal income tax matter. As such I have a
reasonable apprehension of bias in this matter and I am
preparing an application for an independent judge to be
assigned to the matter. Failing this, I am asking that the
matter be heard by a jury that can judge both fact and law.

Your part, if you choose to accept it, is to amend the
attached affidavit in any manner you wish, swear it and
return it to me. I have made several such applications in
the past and the judges have always used the fact that I am
not a reasonable person in order to dismiss my previous
applications. Affidavits from numerous individuals from
across Canada would be very difficult for the judge to
ignore. I am certain that some of you would be considered
reasonable.

If I can get 1,000 affidavits, I will file every one of them
and prove to the judge once and for all that I am a
reasonable person, just like the other 1,000 who have
provided affidavits reflecting their reasonable apprehension
of bias on the part of a federally appointed and paid judge
in a federal income tax matter.

Any precedent set in this matter will obviously be
beneficially available to all.

I, Wallace-Maxwell-Raymond: Dove, of Norland, in the
Province of Ontario, MAKE OATH AND SAY AS FOLLOWS:

1. That all facts herein are true, correct, and
complete, as I verily believe them to be.

2. I am the affiant in this matter and as such have
personal (or direct) knowledge of the facts herein deposed
to by me, except where same is stated to be based upon
information and belief in which case I do verily believe
same to be true.

3. That I am an interested party in this action and as
such have knowledge of the facts presented hereinafter.

4. That I am a full liability flesh and blood living
person .

5. That I present this affidavit as the highest form of
prima facie evidence in these matters.

6. I have been told by Wallace Maxwell Raymond Dove,
and do verily believe same to be true, that he has brought
to the attention of the Ontario Court of Justice and the
Ontario Superior Court of Justice the fact that he has a
reasonable apprehension of bias on the part of judges who
are appointed by the federal government (Governor General)
to administer judgments in the Superior Courts in relation
to government statutes.

7. I have been informed by Wallace Maxwell Raymond Dove
and do verily believe same to be true, that the judges of
the Ontario Court of Justice, namely MacLead of Johnston,
and a judge of the Superior Court of Ontario, namely Duron,
have consistently responded to this reasonable apprehension
of bias held by Mr. Dove by stating that this reasonable
apprehension of bias must be held by a reasonable person,
thus insinuating that Mr. Dove was not such a "reasonable
person."

8. I do verily believe that the Income Tax Act. R.S.C.
1985, c. 1 (5th Supp.) as amended, is an alleged federal
government statute. I say alleged because I have not been
able to find a true, certified and up to date copy of this
act.

9. I have been informed by Wallace Maxwell Raymond
Dove, and do verily believe same to be true, that this
matter involving Mr. Dove is being tried in the Ontario
Superior Court of Judge.

10. I have reasonable grounds to believe and do verily
believe that this matter involving Mr. Dove will be
adjudicated before a judge who is appointed and paid by the
federal government.

11. I have reasonable grounds to believe and do verily
believe that this matter involving Mr. Dove s being
prosecuted by a crown agent who is appointed and paid by the
federal government.

12. I have reasonable grounds to believe and do verily
believe that this matter involving Mr. Dove is being
prosecuted by the Crown on behalf of the Canada Customs and
Revenue Agency whose agent is appointed and paid by the
federal government.

13. I am a reasonable person (Maybe man or woman, your
choice). As a result of my knowledge as evidenced herein,
I have a reasonable apprehension of bias on the part of any
and all federally appointed and paid judges of the Ontario
Superior Court of Justice who are required to hear a matter
involving the Income Tax Act, R.S.C., 1985, c. 1 (5th Supp.)
as amended, or any other federal statute.

14. I have reasonable grounds to believe that all federally
appointed and paid judges of the Ontario Superior Court of
Justice have a pecuniary interest in any and all matters
involving the Income Tax Act, R.S.C. 1985, c. 1 (5th Supp.)
as amended, such that the hearing any matter involving the
Income Tax Act, R.S.C. 1985, c. 1 (5th Supp.) by any of said
judges as amended would, upon the hearing of such matters,
bring the administration of judge into disrepute.

15. Based upon facts that I know and information provided
to me which I believe to be true, as described herein, I
have reasonable grounds to believe and do verily believe
that, in respect of the Income Tax Act, R.S.C. 1985, c. 1
(5th Supp.) as amended, all federally appointed judges of
the Ontario Superior Court of Justice are biased and would
and could not be independent in any matter involving same.
