Exxon Suits Over Human Rights in Indonesia Dismissed

Sept. 30 (Bloomberg) -- A federal judge threw out lawsuits that
accused Exxon Mobil Corp., the world’s biggest oil company, of
being responsible for human-rights abuses in the Indonesian
province of Aceh.

U.S. District Judge Royce Lamberth in Washington today said the
Indonesian villagers didn’t have the right to sue Exxon in a
U.S. court because they are non-resident aliens. He dismissed
lawsuits filed in 2001 and 2007 against the oil company.

In the 2001 suit, 11 Indonesian villagers claimed security
forces working for Irving, Texas-based Exxon committed murder,
torture and rape in Aceh, where the company operates a
government-owned oil and natural gas field and a pipeline. Exxon
denied the allegations. The 2007 case was filed by four
villagers who said they were shot and beaten in 2004.

Lamberth ruled in the 2007 case that the villagers couldn’t use
U.S. courts to sue over actions that took place in Indonesia and
involved the Indonesian military during a period of martial law.
In dismissing the 2001 lawsuit, he said he was relying on the
same legal reasoning.

“We have fought these baseless claims for eight years and
today’s decision validates the company’s assertion that the
claims are without merit,” Margaret Ross, an Exxon spokeswoman,
said in an e-mail. “The company strongly condemns human rights
violations in any form.”

She said Exxon has “worked for generations to improve the
quality of life in Aceh.”

The 2001 case is Doe v. Exxon Mobil, 01-1357, and the 2007 case
is Doe VII v. Exxon Mobil Corp., 07cv1022, U.S. District Court
for the District of Columbia (Washington).
