We all know that employees who are planning to leave the company will
copy certain information that they believe will help them in their new
job. We know it happens but is it right?
That was the question posed before the California Ninth Circuit Court of
Appeals. The court, in the case of LVRC v Brekka, found that the copying
of files and transferring them to Brekka's personal computer and email
was allowable, according to reportage from California Employer Advisor.
But what does this say about non-compete agreements and documents
covered by that and matters considered confidential or trade secret? The
case does not address those issues. However, California Employer Advisor
promises a more detailed look at this case and what it means for
California employers, in an upcoming issue of California Employer
Advisor.
