Hi,
As far as I am aware, if a person works up until 10am (i.e. 3 hours or
more) and then leave the office due to illness, then this is not
considered as sick leave, and thus the staff member who left at 11
should not have to put in for leave. The person who left at 9am should
put in for a full day's sick leave.

I am of the opinion that the manager in question is very irrational by
handling the situation in an in-human way. Since the employees reported
for work and were not able to continue with their normal work as a
result of their health status on the day in question, the manager
treated them unfairly. I think one don't need to be a medical
practitioner to can see that someone is not well especially an
individual you know well.
In terms of the BCEA employees are entitled to 30 days sick leave in a
three year circlus. Three days annually may be taken as uncertified sick
leave which does not require any medical certificate.
If the manager is of the opinion of sick leave abuse then there are
processes such as requiring certified medical certificate from medical
practitioner. This normally may based on the medical history of the
individual and when some counseling/warning have taken place.
If they completed a day's leave what happens to the hours/time they have
worked are they going to be paid overtime for the hours worked.
The appropriate approach would have been making them to fill in time off
or uncertified sick leave.
I suggest your company need to develop leave policy that will guide
ensure consistency in handling issues related to leave.

Why ever would you not process part of a day as sick leave? That means
that a person (hypothetically) could come to work until 9 00 am and then
go off and no leave or sick leave is docked?............. Would
certainly extend the sick leave available if this was allowed and cost
the company large amounts in time off from the workplace.
We process part of days as sick leave and it works well. We have
determined a cut of time i.e. leaving after 12 00 is half day, etc.
It is not fair to the "ever faithfull's" work come to work and get paid,
that their colleagues get paid for not working.

My practice is, leaving after 12:00 is all day and leaving before 12:00
is half a day, hence in your case the 2 employees must fill in a half
day's sick leave. And our system does accommodate half days.

I believe that if a person is sick, but leaves work at 11:00am or after,
then they are considered to have worked that day and do not have to
apply for a day's sick leave.
However if they leave before 11:00, they will have to take a day's sick
leave.

Dear Motshidisi
What we do in our company is to make employees fill a leave form for the
number of hours taken (vacation, sick and family responsibility) and we
capture it on the system. Once the number of hours tally to 8 hours, a
day's leave is automatically deducted from such employee's leave. I
should suppose this is a way to go and some propose same for employees
who take time-off for smoking.

Dear All,
We have two employees who works from 08h00 to 17h00, on a particular day
the one lady was feeling very ill and left work at 11h00, on return her
line manager requested that she should fill in = day sick leave.
The other one left work at 09h00 and was also asked to fill in = sick
leave. Is the = day sick leaves, the BCEA is very silent on this.
The manager in question, argues that the employees are permanent and a
paid a monthly salary which is calculated based on the hour that they
work, and should employees not work those hours then = day leave should
be applied.
In our employment contracts/ policies there is no where we stipulating
that should an employee leave at 10h00 then no leave should be taken
off.
How do we handle people leave work earlier than normal?
