TONIGHT'S FOCUS: Winning the war on terror.

The events of 9/11 led to a fundamental shift in our legal system. Do extraordinary times call for such extraordinary measures? Was 9/11 a criminal act or an act of war? Tonight we examine whether the judicial process has been sidestepped by the administration in the interests of the war on terror.

We know him as the alleged 20th hijacker. This is how most Americans have come to describe Zacharias Moussaoui, a French citizen arrested on immigration violations before the attacks of 9/11, but soon after tied to Al Qaeda and 9/11. In the immediate aftermath of the attacks, it was understandable that the country was looking for someone to blame, some way to hold accountable anyone who may have had anything to do with the events of that terrible day. What better way than a prosecution through the American judicial system--the envy of the world--to show justice at its finest. That was the hope when Attorney General John Ashcroft announced "the first indictments brought against the terrorists of September 11." But since then, the case against Zacharias Moussaoui has fallen apart. He wanted access to witnesses, a fundamental constitutional right, who could support his claim that he had nothing to do with September 11th. Trouble is, those witnesses are also Al Qaeda operatives captured by the U.S. And in the interests of national security, the government argued, they could not be called. The judge in the case said unless Moussaoui gets his constitutional right to talk to them, the government could not him tie him to 9/11 or seek the death penalty. That ruling is under appeal.

But the government has not been consistent in how it pursues these cases. Take American citizen Jose Padilla, accused of plotting a dirty bomb attack. The President declared him an enemy combatant, and he lost the right to his lawyer or to a trial. Again, the government insists national security is at risk.

These are just two of a handful of cases that have emerged as a result of the investigations after 9/11 that have challenged us as a society and as a nation that lives by the rule of law. Challenges that most likely will go all the way to the Supreme Court. Is the country strong enough to use the judicial measures already in place or do the events of 9/11 require a fundamental shift in the judicial process? Nightline correspondent Deborah Amos, producer Elissa Rubin and researcher Caroline Cooper have prepared tonight's report. This is an issue that every American has a stake in. And a note about next week. Ted Koppel will anchor a week of broadcasts from Iraq. On Monday, in a special hour long edition of Nightline, Ted Koppel and executive producer Leroy Sievers will retrace the route they took with the Third Infantry Division from Kuwait into Baghdad during the war. It should be a fascinating broadcast. For the rest of the week they will be looking at the security situation and the rebuilding of Iraq at a time when, despite the capture of Saddam Hussein, the situation in the country remains tense.
